1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Minty Analyst LLC ("Company," "we," "us," or "our") regarding your use of the My Cash Calendar service (the "Service"). By accessing or using our Service, you agree to be bound by these Terms and all applicable laws and regulations.

If you do not agree with any of these Terms, you are prohibited from using or accessing this Service.

My Cash Calendar is a web-based financial planning and cash flow management application that allows users to:

  • Create and manage financial calendars
  • Set up recurring transactions and rules
  • Generate financial reports and statements
  • Share calendar access with authorized users

3. User Accounts and Registration

  • To upload or transmit viruses or any other type of malicious code
  • To spam, phish, pharm, pretext, spider, crawl, or scrape
  • For any obscene or immoral purpose or to encourage anyone else to do the same
  • To interfere with or circumvent the security features of the Service

IMPORTANT: The Service is a tool for organizing and tracking financial information only. WE DO NOT PROVIDE FINANCIAL, INVESTMENT, TAX, OR LEGAL ADVICE. Any information provided through the Service should not be considered professional advice and should not be relied upon as such.

5.2 Accuracy of Information

While we strive to provide accurate tools and calculations, YOU ARE SOLELY RESPONSIBLE for verifying the accuracy of all financial data and calculations. We make no warranties about the accuracy, reliability, completeness, or timeliness of the information provided.

5.3 Third-Party Financial Institutions

The Service may allow integration with third-party financial institutions. We are not responsible for the accuracy of data from these institutions or any issues arising from such integrations.

6. Intellectual Property Rights

10. User Conduct and Content Moderation

All User Content must comply with applicable laws and these Terms. We reserve the right to remove or refuse to post any User Content for any reason.

10.2 Monitoring

We have no obligation to monitor User Content but may do so and reserve the right to remove content that violates these Terms or applicable law.

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting us or using account deletion features within the Service.

11.2 Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.

11.3 Effect of Termination

Upon termination, your right to use the Service will cease immediately. We may delete your account and all associated data, though we may retain certain information as required by law or legitimate business purposes.

12. Disclaimers and Limitation of Liability

12.1 Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

12.2 No Warranties

WE DO NOT WARRANT THAT:

  • THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION
  • ANY ERRORS OR DEFECTS WILL BE CORRECTED
  • THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
  • THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS

12.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MINTY ANALYST LLC, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.

12.4 Cap on Liability

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE LAST TWELVE (12) MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.

13. Indemnification

YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS MINTY ANALYST LLC AND ITS LICENSEE AND LICENSORS, AND THEIR EMPLOYEES, CONTRACTORS, AGENTS, OFFICERS AND DIRECTORS, FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, OBLIGATIONS, LOSSES, LIABILITIES, COSTS OR DEBT, AND EXPENSES (INCLUDING ATTORNEY'S FEES), RESULTING FROM OR ARISING OUT OF:

  • YOUR USE AND ACCESS OF THE SERVICE
  • YOUR VIOLATION OF ANY TERM OF THESE TERMS
  • YOUR VIOLATION OF ANY THIRD-PARTY RIGHT, INCLUDING WITHOUT LIMITATION ANY COPYRIGHT, PROPERTY, OR PRIVACY RIGHT
  • ANY CLAIM THAT YOUR USER CONTENT CAUSED DAMAGE TO A THIRD PARTY

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be interpreted and governed by the laws of the Republic of Bulgaria, without regard to conflict of law provisions.

14.2 Jurisdiction

Any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the local courts of Plovdiv, Bulgaria. You waive any and all objections to the exercise of jurisdiction over you by such courts.

14.3 Arbitration

At our sole discretion, we may require you to submit any disputes arising from these Terms or use of the Service to final and binding arbitration under the Rules of the American Arbitration Association.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the sole and entire agreement between you and Minty Analyst LLC regarding the Service.

15.2 Severability

If any term or provision of these Terms is invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected.

15.3 Waiver

No waiver by the Company of any term or condition shall be deemed a further or continuing waiver of such term or any other term.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

15.5 Force Majeure

We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including acts of God, war, terrorism, pandemic, or government action.

16. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. Material changes will be determined at our sole discretion.

Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
